MISSION STATEMENT


It is the goal of the Ohkay Owingeh Tribal Court to provide an impartial, competent, efficient and independent tribunal to fairly and equally administer justice on behalf of all those who are subject to its jurisdiction. It is also the goal of this Court to define and exercise its jurisdiction to the broadest extent legally possible, thereby fostering the independence and sovereignty of the Pueblo while offering the greatest measure of protection to its people.

8:00 a.m through 5:00 p.m (open during lunch hour), Monday – Friday (Closed Federal and Tribal Administration Holidays) certain closures of the court for Tribal holidays may be given with little notice, please call ahead.

Traffic Violations heard on Wednesdays 9:00 am to 11:30 am

ACCEPTANCE OF PAYMENTS

Payments must be made by debit/credit card, check, or money orders. Cash is not accepted.

COURTROOM RULES

Anyone who does not comply with these rules will be removed from the courtroom and could be held in contempt

Items NOT allowed in Courtroom:

  • Weapons including firearms,sharp object, knives, metal nail files, razor blades, scissors, certain types of cigarette lighters (torch lighters) and anything that can be used as a weapon. All bags, purses, backpacks, and personal items may be searched.
  • Cell phones are not allowed in the courtroom. However, attorneys, spokespersons and service providers may have a cell phoneif a phone is being used for evidence.
  • Electronic devices capable of recording audio/video or taking photos.
  • Revealing or inappropriate clothing. Those dressed inappropriately may be asked to leave and/or required to change their clothes prior to a hearing.
  • Food, drinks, or gum chewing.
  • Hats/caps or sunglasses.

Conduct NOT allowed in the Courtroom:

  • NO talking while court is in session unless addressing the judge or testifying as a witness.
  • NO drugs and/or alcohol. Anyone suspected of being under the influence of either drugs or alcohol could be tested and/or removed from the courtroom and could face contempt proceedings, including possible jail.
  • Any inappropriate behavior will result in removal from the courtroom and possible contempt proceedings including jail.
  • Children must be supervised so as not to disrupt proceedings. If children cannot be quiet they must wait in the lobby.

IT IS YOUR RESPONSIBILITY TO INFORM THE COURT CLERKS OF YOUR CURRENT MAILING, PHYSICAL ADDRESS AND PHONE NUMBER.

IF YOU ARE PETITIONING TO HAVE SOMEONE BROUGHT TO COURT (SUMMONED), IT IS YOUR RESPONSIBILITY TO KNOW THE CURRENT RESIDENCE OF THAT INDIVIDUAL AND INFORM THE COURT CLERKS SO THAT PROPER NOTIFICATION MAY BE MADE.

  • PERSONAL/PRIVATE PARTY – $40.00
  • BUSINESS/CORPORATE/AGENCY- $80.00
  • EMERGENCY PROTECTION ORDERS- NO FEE unless EPO is
  • DENIED or WITHDRAWN by plaintiff- $40.00

COURT COSTS

  • CRIMINAL ARRAIGNMENTS/CIVIL TRAFFIC TRIALS- $50.00
  • CRIMINAL/CIVIL TRIALS- $100.00- $200.00
  • JURY TRIALS- $800.00- $1000.00
  • APPEALS (includes recordings/transcripts)- $250.00

SERVICE OF PROCESS

  • PERSONAL – $20.00
  • BUSINESS- $40.00

COPYING COST

  • STANDARD COPIES- .25 PER PAGE
  • CERTIFIED COPIES- $1.00 PER PAGE
  • HEARING RECORDINGS- $75.00 each proceeding
